CBP Can Now Void Your Importer Number. Check Form 5106 First
Most Amazon sellers filled out their importer paperwork once, years ago, often through a freight forwarder, and never looked at it again. That form now decides whether your next container clears customs.

As of October 2026, US Customs and Border Protection (CBP) says it can immediately void an importer of record number when the information on file is inaccurate or incomplete. The policy follows Executive Order 14411, "Strengthening Customs Enforcement", signed on June 3, 2026, and a CBP notice published in the Federal Register on August 19, 2026. Enforcement started on September 18, 2026, as reported by customs law firms and brokers.
For an FBA seller planning Q4 replenishment and Chinese New Year orders, the timing could hardly be worse. This is a paperwork problem, and it is fixable today. It just is not fixable while your goods are sitting at the port.
What does it mean when CBP voids an importer of record number?
A voided importer of record number is invalid for every purpose, including making entry, according to the CBP notice as summarized by trade counsel. In practice, any shipment filed under that number cannot clear until the number is reestablished.
Two details make this sharper than a normal compliance update:
As reported, the notice describes no warning or cure period before the void. The action comes first and the notice follows.
CBP sends that notice to the email address most recently submitted on your Form 5106. If that inbox belongs to an old forwarder or a former assistant, you may not see it at all.
It applies to records already on file, not only to new registrations. CBP is reviewing existing importer data.
CBP has not published a timeline for reestablishing a voided number, as of October 2026.
This is separate from the inactive number cleanup CBP has also been running in 2026, where numbers with no recent entries were deactivated. An inactive number can generally be reactivated with a new Form 5106. A voided one needs a reestablishment request to CBP.
Which Form 5106 details trip Amazon sellers up?
Based on the CBP notice as described by Clark Hill and other customs counsel, these are the fields to check line by line:
Physical address. It must be your actual place of business, or the individual's own address for a sole owner. A registered agent, customs broker, freight forwarder, P.O. box, business service center or any third party's address is generally not acceptable.
Email address. It must be valid and belong to the importer. A broker's or forwarder's email in that field is a problem.
Phone number. Same rule. It has to be yours.
Broker power of attorney. Your customs broker must hold a power of attorney executed directly with you. As reported, a power of attorney routed through a freight forwarder does not satisfy the rule.
Name and tax ID. The importer name and EIN, SSN or CBP assigned number must match the real entity bringing in the goods.
The patterns trade counsel flag as risky look a lot like how many Amazon businesses were set up: a non US seller using a broker's address because it has no US premises, DDP shipments where the supplier or forwarder acts as importer and their contact details fill the record, and ecommerce sellers listing a 3PL or prep center as their address.
What should you do before your next shipment?
Ask your customs broker for a copy of the Form 5106 data currently on file for your importer number. Do not rely on memory or an old PDF.
Correct anything that points to a third party. Updates are filed through your broker's ABI connection or with the CBP Center of Excellence and Expertise assigned to you.
Confirm your broker holds a power of attorney signed directly by your company, not passed through your forwarder.
Find out who is actually the importer of record on DDP shipments. If it is your supplier or forwarder, their record is now your supply chain risk.
Add buffer stock to your reorder points for the next two inbound cycles, so one held container does not become a stockout in January.
That last step is the one most sellers skip. An inventory management tool that models lead time per supplier makes it easier to see how many days of cover you lose if a container sits at the port for two extra weeks.
Customs accuracy also sits on top of a cost problem many sellers are still absorbing, which we covered in our guide to Amazon pricing strategy under 2026 tariffs.
Is this legal advice?
No. This is an operational checklist based on public reporting as of October 2026. Trade counsel note that inaccurate Form 5106 data can also carry legal exposure, so if your setup involves a non US entity, DDP terms or a third party importer, talk to a licensed customs broker or trade attorney about your specific structure.
Do not let paperwork stop your Q4 restock
A held container in November means empty shelves in the weeks that pay for your year. Book a free account audit and we will map your inbound calendar, reorder points and stock cover so a customs delay costs you days, not your ranking.
Frequently Asked Questions
When did CBP start voiding importer of record numbers?
CBP said it would begin voiding importer of record numbers with inaccurate or incomplete Form 5106 data on September 18, 2026, following a Federal Register notice on August 19, 2026. The policy implements Executive Order 14411, signed June 3, 2026.
What happens if my importer of record number is voided?
A voided number is invalid for every purpose, including making entry, so shipments filed under it cannot clear customs until it is reestablished. CBP sends notice to the most recent email on your Form 5106, and as of October 2026 it has not published a timeline for reestablishment.
Can I use my 3PL or prep center address on Form 5106?
Generally no. As described by customs counsel, the physical address must be your actual place of business, and third party addresses such as a broker, forwarder, registered agent, P.O. box or business service center are not acceptable. Confirm your specific case with your customs broker.
Does my freight forwarder's power of attorney still count?
As reported, no. Your customs broker needs a power of attorney executed directly with your company. A power of attorney obtained through a freight forwarder does not satisfy the rule.
Does this affect sellers who ship DDP?
It affects whoever is the importer of record on those shipments. If your supplier or forwarder acts as importer, their Form 5106 accuracy now determines whether your goods clear, so ask them directly what is on file.
Is a voided number the same as an inactive number?
No. An inactive number was deactivated for lack of recent entries and can generally be reactivated with a new Form 5106. A voided number was cancelled for inaccurate data and needs a reestablishment request to CBP.
How do I protect my Amazon inventory from a customs delay?
Fix your Form 5106 data first, then raise reorder points to cover a longer lead time for the next few inbound cycles. If you want a second pair of eyes on your stock cover, AMZ Expert can review your inventory plan alongside the rest of your account.
Summary
Since September 18, 2026, CBP can void an importer of record number over inaccurate Form 5106 data, with no warning period and no published reinstatement timeline. Pull your record from your broker this week, remove every third party address and contact, and confirm a direct power of attorney before your next container ships.
